FTC Issues Warning Letters to Health Care Employers Regarding Non-Compete Agreements

The Federal Trade Commission, or FTC, has sent letters to several large health care employers and staffing firms warning them to ensure their noncompete agreements comply with the law.  Despite voting recently to withdraw from its defense of former President Biden’s administration’s rule banning noncompetes, this action by the FTC signals that it still intends to actively enforce the antitrust laws against noncompete agreements.  Even employers who do not receive letters from the FTC should examine any noncompete agreements they have and ensure they are appropriately tailored to the circumstances.
